In Montana cash benefits (temporary total disability, or TTD) are paid while you are unable to work. There is also a potential settlement after you have reached maximum medical improvement (MMI) and are released to return to some sort of work. The amount of the benefits depends on whether you are able to return to your old job without a wage loss. They also depend on an impairment rating assigned by either your doctor or an insurance doctor. Your age, education, and the physical restrictions that your doctor imposes at MMI also influence the benefits amount.
Partial disability benefits are provided by Montana law, and sometimes there are other benefits, including the value of future medical benefits. This gets complicated. Whether you are getting what you can and should get, is not something you should decide on alone. Consult a lawyer. The Montana workers' compensation law says an injured worker should be given what the law requires to be given, without the need for a lawyer. Don't count on that! When the injured worker reaches MMI and tries to settle, he or she should not count on the law to work without a legal adviser.
